10 Years Later, Misunderstood DMCA is the Law That Saved the Web

The DMCA (.pdf) was conceived a decade ago as the United States' implementation of an international copyright treaty called WIPO. Hollywood wanted the bill to protect its intellectual property from being infringed on a massive scale, and secured a still-troubling anti-circumvention rule that generally prevents consumers from bypassing copy protection schemes. But history has shown that the far-more beneficial element in the law is a provision that provides ISPs, hosting companies and interactive services near blanket immunity for the intellectual property violations of their users — a provision responsible for opening vast speech and business opportunities — realized and unrealized.

Music trade unites to fight against piracy

Its chief executive Feargal Sharkey, the former Undertones lead singer who has since forged a career in music policy, promised it would present a united front to the challenges facing the industry and speak with a coherent voice to the press, and lobby policymakers in Westminster and Brussels. Sharkey said the new body would mark "a bold new chapter for the UK's commercial music industry", with the launch of a manifesto and a collective submission to the government on illegal file sharing.

Scarlet wint eerste slag tegen Sabam

Judge Rejects 'Making Available' Defense, Orders Teen File Sharer to Pay RIAA $7,400

A federal judge is ordering a Texas college student to pay the Recording Industry Association of America $7,400 to settle copyright infringement allegations involving her use of the peer-to-peer file sharing network Kazaa when she was a juvenile. The decision contradicts last month's mistrial ruling in the nation's only file sharing case to go to trial. The split outcomes underscore that, after five years of RIAA file sharing litigation and some 30,000 lawsuits, the level of proof necessary to demonstrate copyright infringement in the peer-to-peer context varies from judge to judge.

Bush Enacts PRO-IP Anti-piracy Law

U.S. President George W. Bush Monday signed into law a bill designed to increase protection of intellectual property (IP) such as software, films and music by raising penalties for infringement and creating a national "IP czar." The Prioritizing Resources and Organization for Intellectual Property Act of 2007, or PRO-IP Act, creates a high-ranking IP protection overseer, appointed by the Senate and reporting directly to the president. The position's first appointee will likely come from the next U.S. administration. The U.S. Department of Justice will also form a new division dedicated to enforcing intellectual property protection.
