Nederlandse webwinkels klagen Nintendo aan

Zeven Nederlands webwinkels dagen gamesgigant Nintendo voor de rechter. Inzet is om een uitspraak te krijgen over de legaliteit van het verkopen van zogenaamde modchips en flash cards. Nintendo is de laatste tijd streng aan het optreden tegen de verkoop van deze hardware. (...) Volgens Mr C.B. van der Net van SOLV Advocaten is het aanbieden van flash carts en modchips gewoon toegestaan. Dat consumenten daarmee ook eventueel illegaal vervaardigde kopieën van originele computerspellen van Nintendo kunnen spelen, zoals Nintendo beweert, doet daaraan niet af.

'Piraterij is moordend'

De Belgische Vereniging voor Antipiraterij (Baf) bevestigt het probleem van de piraterij voor de videotheken. De jongste studie dateert inmiddels van 2005, maar toen werd duidelijk dat het verlies voor de volledige sector, van bioscoop tot videotheek, 30miljoen euro bedroeg. 'Het illegaal downloaden op het internet blijft maar groeien', zegt Eveline Huys van de Baf. 'Piraterij is moordend voor videotheken. Als een film beschikbaar is op het internet nog voor hij in de videotheek ligt, dan wordt de concurrentie wel erg groot.'

Yahoo! Had A Music Store?

Yahoo! said Wednesday it will help replace the music libraries of consumers who bought tunes from the Web portal that they may no longer be able to play as the struggling company shuts down its Web-based music service. The news comes after Yahoo! (nasdaq: YHOO - news - people ) announced in April that it would shutter its online music store. The problem: Yahoo! has told customers it will also shut down the servers used to validate that the music customers play is not violating copyright laws.

Duffy: downloading music illegally is 'amazing'

Duffy may not be working on the new James Bond film, but at this rate she may still have an assassin after her. And that assassin will have been hired by her record company. The 24-year-old singer has come out as a defender of illegal downloading, celebrating it as a way of "making music a part of everyone's lives". Alhough Duffy is No 2 on the charts at illegal download site MP3 Fiesta, the Welsh belter doesn't seem much bothered. "[Illegal downloading] can go two ways," she explained to ShortList. " Some people think it creates illegal access, but I think the big wheel is round, y'know?"

Dell Tests Player to Renew iPod Battle

In recent months, Dell has been testing a digital music player that could go on sale as early as September, said several Dell officials. Launching the player -- along with an online download service and related software -- would be part of a strategy that Dell Chief Executive Michael Dell hopes will move the company into a broader range of consumer markets than it has served before.

NVPI sust: geen 'heksenjacht' op downloaders

De brancheorganisatie van de Nederlandse entertainmentsector NVPI zal zich bij de bestrijding van schending van auteursrechten richten op de aanbieders en faciliteerders, schrijft de NVPI op zijn website. Daarnaast wil de organisatie via BREIN optreden tegen het 'aanprijzen en faciliteren' van illegale downloads. Consumenten hoeven kortom niet bang te zijn voor een 'heksenjacht' wanneer zij - al dan niet per ongeluk - een illegaal gekopieerd bestand downloaden. De brancheorganisatie neemt eventuele zorgen daarover weg met de mededeling 'dat zij begrip heeft voor het feit dat het voor consumenten niet altijd makkelijk is om legaal aanbod te onderscheiden van illegaal aanbod'.

Celstraf voor illegale muziek op iPod in Australië

Niet schrikken als u binnenkort uw iPod moet afgeven aan Australische douane op de luchthaven. De overheid wil muziekfans controleren op illegale downloads en als er een grote hoeveelheid muziek gevonden wordt, riskeer je zelfs een celstraf.

Illegal sharing is not killing music but scary letters might

The threatening letter on the doormat about licence fee non-payment might soon be joined by another from your local internet service provider. At least it will if you have been virally spreading Coldplay without permission. Bereft, perhaps, of enough incidents of dangerous dogs to merit new legislation, the government is attempting to cut illegal downloading activity by up to 80%. In an initiative involving the record industry trade body, the BPI, the film industry and the government, a memorandum of understanding has been drawn up that will potentially see the half-dozen largest internet service providers in the UK sending out around 1,000 letters a week as a warning to those who use their bandwidth to illegally download, or worse, upload and share music and films.

Tot voor enkele jaren had elke succesvolle film een themasong, gezongen door een bekende artiest. Maar die tijden zijn voorgoed voorbij. De dure artiesten werden opzij geschoven en steeds meer gebruikt men flarden van bestaande nummers in films en series. (...) Pick & mix is om verschillende redenen populair. De filmstudios besparen er in de eerste plaats veel geld mee. (...) Daarnaast spelen de filmmakers op veilig met deze techniek. Voor het illegaal downloaden was men bijna zeker dat de soundtrack van een film goed zou verkopen, wanneer de film dat ook deed.

Britse internetproviders verenigen zich tegen piraterij

De zes grootste internetproviders van Groot-Brittannië zijn met de muziekindustrie en de Britse overheid overeengekomen om online piraterij samen aan te pakken. (...) Providers BT, Virgin Media, Orange, Tiscali, BSkyB en Carphone Warehouse zullen honderdduizenden van hun klanten die verdacht worden van illegale praktijken, binnenkort, een brief versturen met daarin de vraag te stoppen met het illegaal downloaden van muziek, films en andere.

Britain agrees plan to tackle online music piracy

Britain's music and film industries launched a fight back against online piracy on Thursday, persuading the six biggest Internet providers to send warning letters to those suspected of illegal file-sharing. (...) ISPs had previously argued they were mere conduits and not responsible for content. But they agreed to the deal after the British government said it would impose legislation if they did not work to curb illegal file-sharing.

Sky launches net music service

The satellite television company, which also offers broadband access, is teaming up with Universal Music to offer digital access to hundreds of thousands of songs for a monthly fee. Sky said other music industry partners may soon join the service. The new service will launch late this year but details of subscription prices have not yet been made public.

Boetes illegale bedrijfssoftware verdubbeld

De enkele tientallen bedrijven in ons land die vorig jaar betrapt werden op het gebruik van illegale bedrijfssoftware, hebben daarvoor een gemiddelde schadevergoeding betaald van 66.000 euro. Dat zegt de Business Software Alliance (BSA), een belangengroep van grote zakelijke software- en computerbedrijven. Twee jaar geleden lag de gemiddelde schadevergoeding nog bijna de helft lager, op 31.500 euro. Er is dus een duidelijke trend naar hogere boetes voor overtreders. Jacco Brand, de voorzitter van BSA Benelux, schrijft dat onder meer toe aan de inspanningen van zijn organisatie om de grote fraudeurs op het spoor te komen.

Global sales of recorded music fell by 8% in 2007, according to figures released in June by the International Federation of the Phonographic Industry, a trade group. It blamed 70% of the decline on “file-sharing” software, which allows internet users to exchange music and video without paying for it. Industry groups have sued thousands of users of such software, and have supported legislation to criminalise it. But file-sharing has so far proved impossible to stop. And it is not all bad news for the industry, because it can provide helpful insights into music-lovers’ interests. For every song that is bought legally, in shops or online, around 20 songs are illegally downloaded, according to BigChampagne, a firm based in Beverly Hills, California, that compiles and sells statistics about file-sharing. Its customers can find out how many times, and where, a song has been illicitly downloaded, for example, what the figure was five weeks ago, what other music its fans like, and so on. “It doesn’t make sense to put your head in the sand,” says Ken Bunt, head of marketing at Disney’s Hollywood Records, a BigChampagne customer. One of Hollywood Records’ artists, Jesse McCartney, is particularly popular in Italy, so that might be a good place for a tour, says Mr Bunt.

Belgisch piraterijnetwerk in de kiem gesmoord

Agenten van de Computer Crime Unit van de Federale Gerechtelijke Politie Brussel hebben actie ondernomen tegen een groep Internetpiraten die illegale films, series en albums van voornamelijk Belgische auteurs op het Internet plaaststen. De actie is het resultaat van een klacht van BAF nabij de betrokken politiedienst.

'Een op de drie consumenten kopieert dvd's'

Een onderzoek van Futuresource Consulting heeft uitgewezen dat ongeveer een derde deel van de consumenten in de Verenigde Staten en Groot-Brittannië het afgelopen half jaar wel eens een dvd heeft gekopieerd. Voor het in mei van dit jaar uitgevoerde onderzoek werden 3613 Amerikanen en 1728 Britten ondervraagd. Van de Britten heeft 36 procent in de afgelopen zes maanden minstens één dvd gekopieerd; van de Amerikanen 32 procent.

Warning letters to 'file-sharers'

Virgin Media has sent about 800 letters to customers warning them that they should not be downloading illegal music files via file-sharing sites. It is part of a 10-week campaign it is running in conjunction with the BPI to "educate" users about downloads. The BPI, the body which represents the UK record industry, told the BBC that "thousands more letters" would be sent. Its stricter stance on illegal downloaders might result in some ISPs being taken to court, it told BBC News.
