Brein: Kazaa-schikking relatief laag
Volgens de stichting is Kazaa nu ook illegaal in Nederland. "De Australische rechter oordeelde Kazaa illegaal en de Nederlandse rechter past dezelfde principes toe in de Zoekmp3-uitspraak", vervolgt de directeur [Tim Kuik]. "Als je die uitspraak op Kazaa toepast dan kun je niet anders dan tot de conclusie komen dat Kazaa illegaal is, gelijk ook de Australische rechter geoordeeld heeft. Tenzij zij succesvol het illegale verkeer kunnen filteren, is Kazaa verboden." (...) "Het Nederlandse Kazaa-vonnis wekte de onjuiste indruk dat Kazaa legaal was", stelt Kuik. "Dat heeft ervoor gezorgd dat Nederland als een vrijhaven voor dergelijke illegale diensten gezien werd. Dat heeft de ontwikkeling van legale diensten hier op achterstand gezet. (...)"

Kazaa gaat legaal
Sharman Networks Ltd., het Australische bedrijf achter de online muziekuitwisselingsdienst Kazaa, stopt met het aanbieden van illegale downloads en wordt een legale dienst. Kazaa betaalt ook een schadevergoeding van 115 miljoen dollar aan meerdere platenmaatschappijen. Dat heeft de Internationale federatie van de muziekindustrie (IFPI) donderdag bekendgemaakt. ,,De grote platenmaatschappijen zijn tot een akkoord gekomen met de 'peer to peer'-dienst Kazaa'', aldus de IFPI.

KAZAA settles with record industry and goes legitimate
The settlement, announced today by the trade organizations representing the international and US recording industries (IFPI and RIAA), applies to Kazaa's operations worldwide and concludes the ongoing legal proceedings brought by the record companies against the service's operators in Australia and the United States. Under the terms of the settlement, Kazaa has agreed to pay a substantial sum in compensation to the record companies that took the legal action to stop copyright infringement on the Kazaa network. Kazaa will also introduce filtering technologies ensuring that its users can no longer distribute copyright-infringing files.

Recording Industry sues 108 Rhode Islanders for music piracy
The suits are part of an effort by the Recording Industry Association of America to crack down on people who violate copyright laws. The Recording Industry filed three suits in U.S. District Court in Providence last week. They accuse numerous Rhode Islanders of illegally downloading music onto their computers.

Apple Computer has all but cornered digital music, so Amazon.com has set its sights on video downloads. Next month, the online retailer is planning to launch Amazon Digital Video, a service that will deliver full-length feature films and TV shows to customers over the Web, according to a source with knowledge of the offering.

Apple gets French iTunes reprieve
The future of iTunes in France looks more secure after MPs watered down a draft of its new copyright law. The bill had aimed to ensure digital music could be played on any player, regardless of its format or source. But the MPs have amended the draft, to allow copyright holders to set compatibility restrictions. (...) Analysts predicted that had it been forced to share codes, regardless of what artists wanted, then Apple would have shut its French iTunes store rather than comply.

US Yahoo offers copy-free music
Dave Goldberg, the vice president and general manager of Yahoo Music urged record labels reconsider their stance on DRM technology earlier this year. Other companies, such as Wippit and eMusic, already offer MP3 files that can be freely shared.

Yahoo Cracks the DRM Barrier
Yahoo quietly broke a critical sound barrier by selling pop princess Jessica Simpson's latest single [A Public Affair] in MP3 format without the digital rights management software that major record labels have long said is necessary to prevent piracy. Music sector urges buyers to help in piracy battle
Here's a real challenge to Chinese music lovers: When it comes to buying pirated CDs and music, take the same approach former US First Lady Nancy Reagan promoted regarding drugs in the 1980s just say no. That's exactly the theme of a 100-day campaign the General Administration of Press and Publication launched last Saturday. It urges people to resist buying counterfeit discs and publications. And that idea is music to the ears of China's music industry.

Providence man faces deportation in music, movie piracy case
Sidikiba "Marcus" Magassouba was arrested in September and again on July 3 for selling or trying to sell pirated CDs and DVDs at a flea market. Police seized thousands of DVDs and hundreds of CDs in two raids, the attorney general's office said. Magassouba pleaded guilty last week to two counts of selling or trying to sell counterfeit music and movies. He was sentenced to five years of probation and given a five-year suspended prison sentence. But he has been turned over the U.S. Immigration and Customs Enforcement and could be deported to Ghana, the attorney general's office said.

Hof verwijst NAW zaak p2p gebruikers naar lopende bodemprocedure
De uitspraak bevestigt dat BREIN in beginsel recht heeft op de NAW gegevens van inbreukmakende P2P gebruikers. De vraag die in dit Hoger Beroep aan de orde was is of die gegevensverzameling ook door een derde verricht mag worden. Het Hof stelt dat zij op procedurele gronden geen inhoudelijke uitspraak kan doen over die vraag. Of de gegevensverzameling door een derde nu wel of niet rechtmatig is kan het Hof zonder nader onderzoek door deskundigen niet beoordelen.

ISPs renounce music tariffs
Internet companies have slammed calls for a tariff that would mean they have to pay music companies for money lost due to illegal downloads. (...) But the Internet Service Providers' Association today issued a statement rebutting the idea. It said: "[We do] not support abuses of copyright and intellectual property theft. "ISPs bear no liability for illegal file-sharing as the content is not hosted on their servers. Although such files may be transmitted across an ISP's network, ISPs are 'mere conduits' of information, as per the E-Commerce Regulations 2002.

Two people accused of music piracy
A Newport News man and an Isle of Wight person accused of illegally downloading and sharing music are two of 76 people sued nationwide by record companies this week. (...) The suits reflect some of the worst offenders of file-sharing, said officials with the companies. Most of those sued have downloaded hundreds to thousands of songs.

Rood licht voor fusie Sony BMG
De platenmaatschappijen Sony en BMG (Bertelsmann) mogen dan toch niet fusioneren. Het Europees Gerecht van Eerste Aanleg heeft de beslissing van de Commissie die de goedkeuring gaf aan de fusie, vernietigd. Op de beurs heeft het aandeel van EMI intussen een duik genomen, omdat de fusie met Warner nu op de helling staat. Het Gerecht handelt na een klacht van Impala, de internationale vereniging van onafhankelijke muziekondernemingen. Impala stelt dat de fusie een overdreven machtspositie op de markt van muziekopnamen en on-linemuziek meebrengt. De Commissie was Impala niet gevolgd, maar het Gerecht heeft bedenkingen bij de manier waarop de Commissie haar oordeel gevormd heeft.

Pirates of the Internet
Even as companies such as Napster and KaZaa have stolen much of the limelight in the underground Internet world of music piracy, another phenomenon, movie piracy, is on the increase as technology advances makes it easier to download larger files. (...) Kaltman said the Internet piracy costs stem in major part from college communities like the University. According to the MPAA, 71 percent of all active illegal movie downloaders are ages 16-24.

Industry to stop 'music cheats'
The recorded music industry's trade group has asked internet service providers (ISPs) to freeze the accounts of customers who illegally fileshare. The British Phonographic Industry (BPI) has written to Tiscali and Cable & Wireless asking them to suspend 59 accounts for "illegal filesharing". Until now, the BPI has focused on individuals, rather than other firms. (...) We have said for months that it is unacceptable for ISPs to turn a blind eye to industrial-scale copyright infringement.

4 charged with music piracy; 1 sought by police
Four flea market workers are charged with copying and trafficking pirated music and movies. Police seized stacks of DVDs and CDs from two booths there; more than 1,200 from one booth alone. Both raids netted about 1,700 illegal items. Police say they were mainly Latin and Spanish selections.

Music Sales Report Mixed
Declines in sales leveled off thanks to an increase in digital downloads, but consumers bought fewer new releases this year. Sales of music albums in the U.S. declined by 4.2% in the first half of the year, to 270.6 million units, compared with the same period a year earlier, according to data released by Nielsen SoundScan.

FIOD-ECD neemt opnieuw strafrechtelijke actie tegen beheerders illegale p2p-sites
Gisteren heeft de FIOD-ECD onder leiding van het Functioneel Parket twee verdachten aangehouden en in verzekering gesteld die worden verdacht van het beheren van de p2p-websites www.Liquidtorrent.org, www.liquidtracker.org en www.phoenixtorrent.org. Tijdens doorzoekingen in woningen in Den Haag en Den Helder werden diverse computers en administratie in beslag genomen en in Amsterdam werd bij een serviceprovider een server in beslag genomen. (...) De torrents op de sites vormen bovendien een onmisbare schakel in de illegale verspreiding van auteursrechtelijk beschermde bestanden. Daardoor handelen de sites onrechtmatig en zijn (mede)plegers van bedrijfsmatige inbreuken. Dat is strafbaar als misdrijf met maximaal 4 jaar gevangenisstraf en 67.000 euro boete voor personen of 670.000 euro voor bedrijven.

Yahoo's China Challenge
The company's latest headache in China comes in the form of a possible lawsuit by the Britain-based International Federation of the Phonographic Industry (IFPI). The trade group, representing some 1,450 members of the recording industry in 75 countries, accuses Yahoo! China of providing links to illegal MP3 files through its online music search engine. Yahoo China in trouble with music industry
Yahoo China is facing a lawsuit for allegedly infringing the copyright of members of a recording industry group by providing links to illegal music download sites, a spokesman for the group confirmed today. (...) "Baidu.com has already been found guilty of copyright infringement in the Chinese courts; China Yahoo is now in a similar position, choosing to turn a blind eye to the infringements taking place on its service instead of setting the example of responsible practice that we would expect," IFPI chairman John Kennedy said in a recent speech in Shanghai, according to a transcript.

Tribler gericht op uitwisseling legale content: gebruikers niet anoniem
In hun antwoord op de kamervragen bevestigen de Ministers dat gebruikers van Tribler die illegaal materiaal beschikbaar stellen zonder toestemming van de rechthebbenden auteursrechtinbreuk plegen. Zij voegen daaraan toe dat misbruik wordt ontmoedigd doordat gebruikers niet anoniem zijn. Het up- en downloadgedrag, IP adres, land en de locatie van gebruikers worden vastgelegd. Inbreukmakende gebruikers kunnen dan ook aansprakelijk worden gesteld en tot schadevergoeding worden veroordeeld, aldus de Ministers.

BPI gets go-ahead to sue MP3 site
Members of the British Phonographic Industry (BPI) want to prove the site, which offers downloads for as little as five pence, is illegal. They were given the go-ahead to sue the company last week, and say proceedings will be issued in Russia this week. (...) Allofmp3.com is the UK's second most popular download site, accounting for 14% of downloads, a survey has said.
