Swedes in good hands with P2P insurance policy?

File-sharers in Sweden, which recently began cracking down on Internet piracy, can now buy insurance to protect themselves from government fines. Magnus Braath, a 29-year-old architecture student, is offering to pay fines for any Swede convicted of the country's new antipiracy law. People unwilling to give up the practice of downloading copies of copyright music, movies or games can go to Tankafritt.nu and pay 140 Swedish crowns, about $19, for annual coverage.

Digital music fans reach new peak

One in five Americans over the age of 12 now owns a portable digital music device, and one in 20 of those quizzed said they possessed more than one. The poll, carried out by market research company Ipsos, showed ownership of the gadget had nearly doubled since 2003. It also revealed that younger consumers are driving the recent growth, with 54% of US teens now owning an MP3 player. (...) The survey also revealed that younger owners are utilising their devices to watch videos and listen to the radio, in addition to using it for music storage.

France approves iTunes rights law

Under the bill, companies such as Apple, Sony and Microsoft could be made to share their proprietary copy-protection systems. It was intended to deter piracy and ensure no single company dominated the fast-growing music download market. (...) The law has been watered down and the loophole to allow artists to sign exclusive deals with individual companies was added last month. (...) The legislation also includes anti-piracy measures threatening fines of thousands of euros and prison sentences for professional copiers.

Music piracy ubiquitous in Mexico

On Genova Street in downtown Mexico City, illegally copied CDs of music by top U.S. artists sell for 20 pesos, just under $2 a piece, in tiny booths between tables overflowing with batteries, stuffed animals and cheap knockoff sunglasses. That's about one-tenth the price in nearby stores. (...) Unauthorized downloads are a global challenge for the music industry, but the problem is becoming particularly serious in Mexico, where intellectual property laws don't punish file-sharing and a rising number of people are getting the broadband Internet connections that make it easier to download content at high speeds.

Virgin France fined over piracy

French music retailer Virgin France has been fined 600,000 euros ($754,266; £414,147) for music piracy. The firm, owned by Lagardere, was fined for illegally downloading Madonna's Hung Up to resell on its own website. An industrial court found Virgin France unit Virginmega had ignored an exclusive deal reached by Warner Music France with France Telecom and Orange.

Music download service unveiled for digital radio

British consumers are set to be the first in the world able to buy songs instantly as they listen to them on digital radio, using a download service announced on Monday by UBC Media. The London-based radio programming producer said it would begin testing the technology on Chrysalis Group's Heart station, with plans for a full roll-out by December. It added that digital-radio-enabled mobile phones would be available later this year.

Technische toepassing om illegale sites inzake kinderporno te blokkeren in ontwikkeling

Vandaag is op de ministerraad beslist dat de Federale overheidsdienst Informatie en Communicatietechnologie (Fedict) een technisch concept mag uitwerken om websites met illegale content of met illegale dienstverlening te onderscheppen. Het gaat om een voorstel van Minister van Werk en Informatisering Peter Vanvelthoven.

Anti-piraterij actie op GMM [Graspop Metal Meeting] 2006 levert 300 illegale kopieën van Cd's en Dvd's op

Op de weide was er naar jaarlijkse gewoonte een Metal Market georganiseerd waar festivalgangers Cd's en Dvd's konden kopen aan een 40-tal kraampjes. Twee standhouders, afkomstig van Nederland, verkochten er illegale kopiën van Cd's en Dvd's. In totaal werd er een 300-tal illegale kopieën in beslag genomen. Het betrof meestal illegale bootlegs, deze bevatten meestal illegale opnames van concerten, maar ook niet-uitgebrachte studio-opnames of ongeautoriseerde remixen. De actie werd ondersteund door de politiezone Balen-Dessel-Mol.

France rolls over on iTunes DRM-busting law

The Dadvsi law, which originally included provisions to allow people to crack DRM protections and oblige Apple to interoperate with its rivals' music download services and vice versa, gained the approval of French lawmakers yesterday. Now the bill gives Apple and its rivals a "get out of jail free card": While interoperability is still mandated, it doesn't have to be enforced if the online song shops have the permission of the rights holders--musicians and record labels, for example--to use DRM.

In een recent interview in The Wall Street Journal heeft de rijkste man ter wereld, Bill Gates onlangs laten weten wel eens illegaal naar filmmateriaal op internet te hebben gekeken. Nu zijn er heel veel mensen die wel eens illegaal materiaal via internet hebben binnengehaald, maar dat nu uitgerekend Bill Gates, de man die zich juist altijd als een soort kruisvaarder tegen het illegaal verspreiden en in het bezit hebben van dit soort materiaal heeft opgeworpen zich hieraan schuldig heeft gemaakt, is op zijn minst opmerkelijk.

Who benefits from the death of mycokemusic.com?

On Tuesday the music download site abruptly announced that it will sell no more songs, and that it will cease business on July 31, although you can have any credit stored on the site shifted to any other music download site run by OD2 (On Demand Distribution) by August 31. (...) The study by XTN Data found that iTunes is still well ahead, with a 44% market share, though the Russian site AllofMP3 is now in second place with 14%. Napster is third with 8%, while Wippit fell to fourth with 6%. Mycokemusic and Tesco had "marginal" market percentages.

French digital music law heads for vote

French legislators on Thursday agreed to final wording of a potentially precedent-setting law that could see Apple Computer license its iTunes song format to rivals. The text, woven together from divergent versions passed earlier this year by the two chambers of the French legislature, is scheduled for a final vote without debate next week by the Senate and National Assembly. Among the most controversial provisions in the law is a reduction of penalties for downloading music to the judicial equivalent of a parking ticket.

Valence Media, the parent company of Torrentspy.com, charges that the MPAA paid the Canadian resident [Robert Anderson] $15,000 for information on Torrentspy and its executives, according to documents filed Thursday with the U.S. District Court for the Central District of California in Los Angeles.

Marcel Heymans gaat onkruid wieden in plaats van illegale downloaders

Nog tot uiterlijk 1 juli heeft hij [Marcel Heymans] zichzelf gegeven: om lopende zaken af te werken en om zijn opvolger en huidige rechterhand, Olivier Maeterlinck, te laten roderen in zijn nieuwe rol. (...) In 1996 verkaste Heymans naar de Belgische afdeling van IFPI, de internationale federatie van de fonografische industrie. Daar ontwaakte de Heymans zoals hij nu bekend is in het milieu van illegale downloaders: bewaker van een harde, no-nonsenseaanpak, bijwijlen onbeschroomd om een boosdoener voor het gerecht te slepen en schadevergoedingen van tien- tot honderdduizenden euro's te eisen.

Clicks drive boom in legal music downloads

A rash of copyrighted music download websites have launched in China over the past few months, offering rapid access to the latest pop hits for around one yuan (13 US cents) per song. Of course Internet search engines can still pick up illegal free download sites, but all the talk of intellectual property rights (IPR) makes some people feel guilty about stealing music online. Instead of breaking the law they can now visit legal sites such as top100.cn, which boasts a million-song catalogue.

Dutch MP3 search site shut down

The Zoekmp3.nl site, run by Techno Design, was shut down after the decision by the Dutch Court of Appeal. It ruled that the site was breaking the law by providing links to illegal MP3 files on the internet, even though it did not host the content itself. (;..) "It sends a clear message to others operating 'mp3 search' services that they will be held liable for the damage that they cause." The IFPI said this was the latest in a series of judgements against so-called deep link websites which offer links to copyrighted music. Similar websites have been found to be illegal in Australia and China.

[VIDEO] Report: Apple in talks to offer movies at iTunes

Apple Computer is in talks with most of Hollywood's studios to offer movie downloads via its popular iTunes Music Store Web site, show business newspaper Daily Variety reported Monday. (...) Apple's Chief Executive Officer Steve Jobs is said to want one flat price of $9.99 per movie, whereas studio executives want a range of prices that mirrors videos and DVDs at retail stores which, generally speaking, run from discount titles at a few dollars apiece up to $19.99 or more for new releases.

Sony BMG Music Entertainment wants to give bloggers free music and video--sort of.

The music conglomerate is promoting a new site, called Musicbox Video, that showcases videos, artist interviews, behind-the-scenes footage and other material from a broad portfolio of its artists. Want to see a film clip of Bruce Springsteen singing "The River" from the 1980 movie "No Nukes" or some clips from Franz Ferdinand? The site has it. But Sony will also actively encourage fan sites and bloggers--who are mostly used to receiving cease-and-desist letters from studios--to link to the material. (...) Individuals thus could create sites focused around certain artists by linking to video channels on the Musicbox site dedicated to them, or link to several channels which, in the aggregate, comprise the most mawkish artists (in the view of the blogger) that Sony has to offer.

In het kader van het wereldkampioenschap voetbal heeft de brancheorganisatie van Amerikaanse filmstudio's MPAA een voorlichtingstrailer uitgebracht waarin Pelé, een van de grootste voetballers aller tijden, een statement maakt tegen piraterij. Pelé belichaamt 'fair play' en de liefde voor sport en is een blijvende inspirator voor jonge sporters wereldwijd.

Brein: Nederland toevluchtsoord voor dubieuze sites

"Nederland is in toenemende mate een toevluchtsoord voor sites die illegaal materiaal aanbieden", aldus Kuik donderdag tijdens een bijeenkomst van ECP.nl. "Ik denk dat het in Nederland niet zo goed is gesteld met de handhaving." Als voorbeeld haalde de Brein-directeur de torrent-site Pirate Bay aan. (...) Het conflict tussen Brein en de providers spitst zich in Nederland met name toe op het verstrekken van naw-gegevens van abonnees die muziek aanbieden via p2p-diensten. De providers weigeren die informatie aan Brein af te staan. Een zaak over deze kwestie tussen Brein en een aantal grote internetaanbieders ligt op dit moment bij het Hof.

Hof Amsterdam: Zoekmp3 is illegaal

Vandaag heeft het Hof in Amsterdam uitspraak gedaan in het door BREIN ingestelde hoger beroep in de zaak tegen zoekmp3. Het hof kwalificeert de activiteiten van zoekmp3 als illegaal; als je massaal links naar illegale bestanden aanbiedt dan is de hele site verboden en hoeven rechthebbenden niet elke link naar illegale bestanden afzonderlijk te melden. (...) BREIN directeur Tim Kuik: "het vonnis van de lagere rechter is op alle punten afgewezen en het hof heeft nu de gewenste duidelijkheid verschaft. Met je site gebruik maken van het illegale misbruik van je klanten mag niet. Dat geldt dus ook voor linksites en andere online intermediairs."

Zoekmp3.nl moet stoppen van Nederlandse rechtbank

De zoekmachine Zoekmp3.nl met links naar muziekbestanden op internet moet haar activiteiten staken. Dat heeft het gerechtshof in Amsterdam besloten in een zaak die door de antipiraterij-organisatie BREIN was aangespannen. Volgens het hof handelen de exploitanten van de zoekmachine onrechtmatig omdat ze geen rekening houden met "belangen van de auteurs- en nabuurrechthebbenden op die bestanden". Het hof veegde het argument van tafel dat de exploitanten gebruikers van de zoekmachine waarschuwden tegen inbreuken op die rechten.

Arrest in de zaak van de stichting BREIN vs Techno Design "Internet Programming" NV

Exploitatie van zoekmachine, gericht op mp3-muziekbestanden, is niet zonder meer onrechtmatig. Echter structureel gebruik gemaakt van de beschikbaarheid op internet van ongeautoriseerde bestanden. Waarschuwing tegen inbreuken op de auteurs- en nabuurrechten van anderen is onvoldoende.

NFOrce staakt hosting van Thepiratebay

De Roosendaalse hosting provider NFOrce heeft besloten haar hosting van de illegale bittorrentsite Thepiratebay stop te zetten. Die beslissing is genomen na sommatie van BREIN om het hosten te staken teneinde medeplichtigheid aan een strafbaar feit en aansprakelijkheid voor schade te voorkomen.

The RIAA is still fighting piracy

The Recording Industry Association of America is suing XM Satellite Radio, which recently introduced a portable player that lets subscribers record songs. (...) "The problem has not been eliminated," says association CEO Mitch Bainwol. "But we believe digital downloads have emerged into a growing, thriving business, and file-trading is flat." This shows true with online digital music sales going up 77 percent in the last year, making up for the 3 percent drop in album sales.

Indie labels want copyright shift

The UK's independent music labels want a change in the law so internet service providers (ISPs) become liable for illegal file-sharing by their users. The Association of Independent Music (Aim) has outlined the plans in a discussion on copyright reform. (...) The Aim-led initiative - which represents a wider group of musicians, music managers and record labels - wants to move away from bringing legal action against individuals who upload music to internet file-sharing services, and encourage the emergence of legal sharing services.

Music piracy in India pegged at 56%, China 85%

Despite being infamous for the high rate of piracy in the music industry, India still ranks below countries like Paraguay, China, Indonesia, Ukraine, Russia, Mexico and Pakistan, says the International Federation of the Phonographic Industry (IFPI) in one of its recent research reports. However, IFPI has put India, which is plagued with a 56% piracy rate, on its list of priority countries for the first time ever, due to the sharp rise in CD-R (recordable compact discs) piracy and the ready availability of mp3 files online.

Daddy Yankee Defends Music Piracy in Peru

Music piracy is unstoppable, and justified for poor fans, Puerto Rican reggaeton sensation Daddy Yankee said Saturday in the Peruvian capital of Lima. Daddy Yankee spoke before a one-night appearance to promote his "Barrio Fino en Directo" album, which features live and remixed versions of 2004 hits like "Gasolina" and "Lo Que Paso Paso." (...) Botswana: Local Artists Nab Pirates

Tiro Baikananyi, Phikwe based Pantsula artist who goes by the stage name Tyrozee, has complained about music piracy after catching a trader in Francistown selling his album, illegally. (...) It appears that the artist's biggest enemy is the world's advance in technology, which was previously supposed to make life easier for the artist. But there are those using the technology to rob artists of their dues. Radio cassette recorders, CD and DVD writers are used to illegally copy and sell artists' works on the underground market.

Studio Brussel zendt zijn programma's sinds gisteren niet alleen meer uit via de traditionele internetradio, maar doet dat ook via peer-to-peer -netwerken. Die technologie is vooral bekend van software als Kazaa en E-donkey, waarmee illegaal films en muziek worden uitgewisseld, maar kan ook gebruikt worden om radioprogramma's legaal te verspreiden. (...) Met unicasting betaalt de VRT per individuele gebruiker. Hoe meer gebruikers, hoe hoger de kosten. Met P2P kan hij in die kosten snoeien, omdat er veel minder internetverbindingen gelegd worden. De internetluisteraars betalen dan voor een stukje mee, omdat zij via P2P immers ook informatie doorsturen naar andere luisteraars, ze uploaden informatie.

New CD swap site to give back to struggling artists

A new Web site that aims to transform music industry economics is set to go live on Thursday, giving musicians a major cut of the proceeds while largely freezing out record labels and other intermediaries. Lala.com, which allows fans to trade music discs for just $1, plus shipping, pledges to give a fifth of its sales to all the musicians, including lesser known session studio players, involved in the making of CDs exchanged on its site.

Online music row shuts web site

Internet firm Tiscali has suspended its music sharing Juke Box and accused the European recording industry of being "virtually impossible to work with". (...) However the IFPI decided Tiscali "was paying to offer one type of service but was actually offering another very different one". Uitspraak vonnis Auvibel (PDF)

De rechtbank van eerste aanleg te Brussel heeft op 24 mei 2006 uitspraak gedaan in een zaak van Auvibel versus een niet nadergenoemde vennootschap volgens recht van Engeland en Wales (met exploitatiezetel in Duitsland) die via het Internet, aan onder andere Belgische consumenten (getuige Belgische domeinnaam, Belgisch bankrekeningnummer), dragers voor het reproduceren van audiovisuele werken verkoopt zonder daarvoor aangifte te doen bij Auvibel. Bijgevolg werd geen heffing betaald die vereist is voor het verkopen van dragers bedoeld om te kopiëren voor eigen gebruik. Het vonnis bepaalt: - de staking van deze inbreuk op straffe van een dwangsom van 5000 euro per inbreuk of, indien het bedrag van de vergoeding verschuldigd over de transacties waarvoor geen tijdige en correcte aangifte werd gedaan hoger zou zijn, twee keer het bedrag van de verschuldigde vergoeding, in het ene of het andere geval per dag dat de inbreuk voortduurt. - de bekendmaking van het vonnis in twee Nederlandstalige tijdschriften naar keuze van Auvibel, bij toepassing van artikel 87 § 1 alinea 6 van de auteurswet.

UK music fans can copy own tracks

UK music fans no longer face the threat of prosecution for copying their own CDs on to PCs or MP3 players, as long as the songs are only for personal use. Peter Jamieson, chairman of the British Phonographic Industry, said consumers would only be penalised if they made duplicates of songs for other people.

Warning over 'illegal' MP3 site

Record industry trade association the BPI said consumers were breaking UK copyright law because allofmp3.com was not licensed to sell recordings. The Russia-based site, which offers albums to download for as little as £1, claims to be licensed. (...) Illegale Zweedse bittorrentsite probeert doorstart in Nederland

Vorige week nam de Zweedse politie de servers van 's werelds grootste illegale bittorrentsite Piratebay in beslag. Ook werden enkele medewerkers aangehouden voor verhoor. De eigenaren van deze illegale site gaan er van uit dat het linken naar illegale bestanden legaal zou zijn. (...) De piraten hebben nu een onderkomen gezocht bij NFOrce die op haar beurt weer bij Leaseweb staat. Deze Nederlandse hosting providers staan internationaal bekend als gastheer voor meerdere illegale bittorrentsites.

MPs in digital downloads warning

Consumers should be told exactly what they can and cannot do with songs and films they buy online, says an influential group of MPs in the UK. (...) A public inquiry organised by the MPs sought views on copy protection technologies, known as Digital Rights Management (DRM), from industry groups, consumers and media makers earlier this year. De Torrent-site The Pirate Bay, die woensdag door de Zweedse politie uit de lucht was gehaald, is zaterdag opnieuw geopend via Nederlandse servers. Technological Advancement Hampering Efforts to Curb Music Piracy

As part of efforts to protect local musicians from massive revenue losses through piracy, the department of arts and culture is debating a proposal to impose a levy on blank recording tapes and CDs. Police hit major BitTorrent site

More than 50 law enforcement officials raided 10 locations, confiscating the computers and detaining three people. ThePirateBay.org had described itself to be the largest search index for BitTorrent, a system used for sharing large files across the internet. (...) In the past, the country had been singled out for criticism by Hollywood. With no law banning file-sharing, Sweden had become a hotbed of piracy where films, music and software were readily swapped.
