Briefly buoyed by their Supreme Court victory on file sharing, Hollywood and the recording industry are on the verge of confronting more technically sophisticated opponents. HP to stop selling Apple's iPod

Although HP plans to stop selling Apple's players, it will take some time for that to happen. The computer maker recently announced a new lineup of HP-branded iPods. Camp said HP plans to continue reselling the music players through the end of September, when it expects to have sold through its inventory of iPods, iPod Minis and iPod Shuffles. Camp said that HP's "current plan" is to continue including Apple's iTunes software on its desktop and notebook PCs, as it has done since last year.

Napster launches radio song sales

Muziekfans die illegaal liedjes delen op het web, kopen ook voor vier keer meer geld muziek dan mensen die het internet niet gebruiken. Dat blijkt uit een onderzoek van het onderzoeksbureau The Leading Question, waaraan zeshonderd mensen deelnamen. (...) Volgens Paul Brindley, de directeur van The Leading Question, zijn de mensen die al downloadend het auteursrecht schenden, dus waardevolle klanten. ,,Het is een mythe dat alle illegale downloaders huurlingen zijn die de wet willen breken ter eer en glorie van de 'vrije muziek'.

Ook Belgische rechter bestraft 'spiegel schijnconstructie'

Onlangs heeft de President van de rechtbank Brussel een constructie waarmee de thuiskopiewetgeving werd ontdoken, bestraft. De rechtbank wees vonnis in een kort geding tegen het in Breda gevestigde bedrijf Storpro en het in Knokke gevestigde bedrijf Memo Media. Het kort geding was aangespannen door Auvibel, de Belgische zusterorganisatie van Stichting Thuiskopie.

Wie voor de eerste maal betrapt wordt op de productie of verkoop van illegale kopieën van films en spelconsoles, kan voortaan een Anti-Piraterij Verklaring ondertekenen. Een zestienjarige piraat kreeg de primeur van het Ik-zal-het-nooit-meer-doen-contract. (...) Kleine garnalen die voor het eerst betrapt worden, krijgen met het contract een tweede kans. Brein overweegt actie tegen klanten Teledirekt

Afgelopen vrijdag oordeelde een Rotterdamse rechter dat Teledirekt moet stoppen met de verkoop van de DVD X Copy-software van het Amerikaanse 321 Studios. Ook moet het postorderbedrijf de kopieën van de facturen overleggen aan Brein. Of Brein de individuele en zakelijke klanten gaat aanpakken die deze software bij Teledirekt hebben gekocht, is volgens directeur Tim Kuik van stichting Brein nog onzeker. Hij beraadt zich nog over eventuele vervolgstappen tegen klanten.

Representatives of South Africa's music industry have ambitious plans to develop the local sector and make it a meaningful player in the economy. Brein wint kort geding over dvd-kopieersoftware

Dit is het gevolg van een uitspraak van de kort gedingrechter in Rotterdam, in een zaak die door Brein was aangespannen. Het postorderbedrijf Teledirekt hield zich bezig met het verhandelen van DVD X Copy, een kopieerprogramma dat de kopieerbeveiliging op dvd's omzeilt.

Legal music downloads triple in 2005; file-sharers take heed of lawsuits

Legal music downloads in the first six months of 2005 in the US, the UK, Germany and France outstripped the total for the whole of last year. Single track downloads in these markets have risen to 180 million in the first half of 2005 compared to 157 million for the whole of 2004. This is more than three times the 57 million downloads of the first half of 2004. (...) Buma/Stemra wil vergoeding van podcasters

Buma/Stemra wil podcasters een vast bedrag vragen voor de gedraaide muziek. Voor 'amateurs' bedraagt de maandelijkse vergoeding 35 euro. Commerciële podcasters die muziek draaien, zijn minimaal 85 euro per maand kwijt, zo meldt Emerce. Het gaat om een tijdelijke regeling die tot januari 2006 van kracht blijft. (...) Podcasters zijn formeel ook nog verplicht om toestemming te vragen bij de platenmaatschappijen voor de naburige rechten.

Apple videos hint at film ambitions

Geen muziek meer op nieuwsgroepen

GQ magazine editor Dylan Jones (...) admits he has become obsessed with his must-have gadget, and has rediscovered his love of music through the device. (...) Free Record Shop heeft een eigen downloadshop, maar moet een zware strijd leveren tegen de gratis downloaddiensten. Directeur Hans Breukhoven over p2p en de prijs van cd's en dvd's. (...) Het is natuurlijk onzin om te zeggen dat elke niet betaalde download meteen een gemiste verkoop is. Wat we wél weten, is dat de schade door het downloaden van illegale content op basis van diverse onderzoeken geschat kan worden op 15 tot 20 procent van de legale omzet. (...) Helemaal gratis is het downloaden trouwens helemaal niet. Alleen is het jammer dat de enigen die goed geld aan het illegale verkeer verdienen de service providers zijn die breedbandverbindingen verkopen.

Apple boekt recordwinst

De Amerikaanse computerfabrikant Apple heeft in het derde kwartaal van het boekjaar 2005 de hoogste omzet en winst uit zijn geschiedenis geboekt. 60.000 multimediaproducten onderschept in België

Vorig jaar hebben de politie en de gerechtelijke diensten meer dan 60.000 illegale video's, cd's en dvd's in beslag genomen. Dat blijkt uit de jaarcijfers van de Belgian Anti-Piracy Foundation (BAF). Australia: internet linking sites ruled illegal; ISP found liable for music piracy

The Federal Court of Australia ruled today that Stephen Cooper, the operator of the website www.mp3s4free.net, was liable for authorising copyright infringement by linking to infringing music files on the internet. Justice Brian Tamberlin found that: "Cooper has permitted or approved, and thereby authorized, the copyright infringement by internet users who access his website and also by the owners or operators of the remote websites from which the infringing recordings were downloaded."

Providers hoeven gegevens niet af te staan aan Brein

De uitspraak van de Utrechtse rechtbank is het voorlopige sluitstuk van de strijd tussen Brein en de Nederlandse providers Planet, Chello, @Home, Tiscali en Wanadoo. Inzet van de rechtszaak waren de naam-, adres- en woonplaatsgegevens van enkele tientallen abonnees die via uitwisselprogramma's als Kazaa muziek hebben aangeboden. Brein heeft van deze mensen alleen het ip-adres en wil dat de providers daar de bijbehorende naw-gegevens bij leveren. De internetaanbieders weigerden dat te doen. De meeste providers leveren dergelijke informatie immers alleen aan justitie.

Europese Commissie wil downloaden stimuleren

De Commissie is onder de indruk van het succes dat het legaal downloaden van muziek boekt in de Verenigde Staten. De digitale muziekverkoop was er in 2004 zo'n 207 miljoen euro waard, terwijl ze in Europa een schamele 27 miljoen opleverde. Het verschil zit volgens de Commissie niet in de piraterij en het uitwisselen van illegale muziekbestanden, maar in de hoge kosten voor de licenties. Daarom is een eengemaakt Europees auteursrecht nodig. (...) Om één liedje legaal aan te bieden in alle 25 lidstaten, moet een bedrijf dus ongeveer 475.000 euro ophoesten. Zo moet een song liefst 4,75 miljoen keer gedownload worden om de business rendabel te maken.

Dell, Napster Team on Music for Students

Dell and Napster have teamed up to offer discounted computers, software, and digital music for U.S. college students, in the name of legal Internet music downloading. (...) The University of Washington will be the first school to try it out later this year, Dell says. The company will install 10 Dell PowerEdge 1855 blade servers on the University of Washington's Seattle campus. The servers will hold Napster's songs and other content so students can download them faster.

Opera chooses BitTorrent to supercharge browser

OPERA Software is showing off a new version of its browser that includes support for BitTorrent. The company says that integrating "this popular file-downloading technology" in the browser "offers the end user a faster download process by utilizing full bandwidth and reducing the chance of in-transfer delay when multiple users download the same file." (...) Opera says it hopes to make it easier for users to download the large amount of legal material available in Webland, such as Linux software and computer game demos. The Opera browser will also be offered as a torrent file.

Musicians have begun looking to mobile phones to reach fans directly, bypassing the record label. Andy Cato of dance act Groove Armada has teamed up with O2 in the UK to offer tracks for download to mobiles. Gerecht klist illegale downloaders op fuif in De Pinte

Op een zogenaamde 'lan-party' in De Pinte zijn op 6 mei achttien harde schijven in beslag genomen, waarop in totaal 53.926 muziekbestanden en 2.689 films stonden. (...) De controle in De Pinte werd uitgevoerd door de Belgian Anti-Piracy Foundation (BaF) in samenwerking met de dienst Zwendel en Namaak van de gerechtelijke dienst van het arrondissement en de Computer Crime Unit (CCU) van Gent. (...) De uitnodigingen voor de party werden via e-mail verstuurd naar een beperkte groep. Een van de ontvangers lichtte de auteursrechtenvereniging Sabam in, die op haar beurt BaF en Ifpi Belgium verwittigde. Dat meldt de Belgian Anti-Piracy Foundation.

De controle vond op 6 mei plaats, maar het nieuws werd nu pas bekendgemaakt. De LAN-party was georganiseerd door een plaatselijke vereniging uit De Pinte. De uitnodigingen voor de party werden via e-mail verstuurd naar een beperkte groep. Eén van de ontvangers lichtte de auteursrechtenvereniging Sabam in, die op haar beurt BaF en Ifpi Belgium verwittigde. Dat meldt de Belgian Anti-Piracy Foundation vandaag.

Metallica wil zijn muziek niet in webwinkel Apple

Metallica en de Red Hot Chili Peppers willen niet dat Apple hun muziek per nummer via internet verkoopt. (...) Het aanbieden van losse muzieknummers zou het einde van het muziekalbum kunnen inluiden, zo vrezen de bands. (...) Vijftigduizend muziekbestanden in beslag genomen op LAN-party

In de uitnodigingsmail voor de LAN-party stond vermeld welke bestanden op het lokale netwerk beschikbaar zouden zijn, zodat de deelnemers die ter plaatse konden downloaden en uitwisselen. "In totaal werd er in de mail melding gemaakt van honderden films, waaronder recente titels als 'Man on Fire', 'King Arthur', 'The Bourne Supremacy' en 'The Incredibles'. Daarnaast ook tv-series, zoals 'Alles kan beter', 'Het Eiland', 'Matroesjka's' en meer dan 10.000 audiobestanden, goed voor minstens 1400 Gb unieke data.

Global raids target piracy gangs

Led by the FBI, the search and seizure operation netted copyrighted material worth $50m and led to seven arrests. Eight servers used to distribute the pirated goods to net users and file-sharing networks were shut down. (...) The raids, called Operation Site Down, were carried out in the US, Canada, Israel, France, Belgium, Britain, Denmark, the Netherlands, Germany, Portugal and Australia. (...) BitTorrent willig doelwit voor rechtszaak

Ezpeer found not guilty in landmark copyright verdict

Taiwan's music industry suffered a setback yesterday when the Shihlin District Court found a local peer-to-peer (P2P) file-sharing operator not guilty of infringing intellectual property rights. In the nation's first ruling on file-sharing cases, the court found that Weber Wu, president of Ezpeer -- which provides a for-fee platform for subscribers to swap files -- did not engage in reproducing or publicly distributing works of copyright holders.
