Leading music industry executives are calling for an alliance with their Hollywood counterparts in the costly fight against piracy. According to the Financial Times website, former International Federation of the Phonographic Industry (IFPI) chief Jay Berman has been asked to approach film executives to discuss a partnership.

BitTorrent-site zoekt geld voor rechtszaak

LokiTorrent fights MPAA legal attack

LokiTorrent, a Web site and index of files available through a peer-to-peer technology known as BitTorrent, posted a letter from the Motion Picture Association of America (MPAA) on its site on Tuesday. The letter states that the MPAA has filed suit in district court in Texas against the site and demands that Loki Torrent cease linking to video files that could infringe on studios' copyrights.

15 jaar cel voor illegale software en films

Het Amerikaanse Ministerie van Justitie heeft een man veroordeeld voor het verspreiden van illegale software. Hij kan tot vijftien jaar gevangenisstraf krijgen. Het is de eerste veroordeling die voortkomt uit Operation Fastlink: een internationaal samenwerkingsverband van politie en justitie in de strijd tegen softwarepiraterij. De 26-jarige Jathan Desir was aangeklaagd vanwege zijn vermeende rol in een criminele onderneming die via het internet illegale kopieën distribueerde van software, films en muziek. Desir bekende schuld en kan dus maximaal vijftien jaar cel krijgen. De strafmaat wordt bepaald op 18 maart 2005. Operation Fastlink werd april 2004 opgericht door openbaar aanklager John Ashcroft. Sindsdien zijn meer dan 120 huiszoekingen verricht in 27 Amerikaanse staten en 11 verschillende landen.

Duitsland krijgt copyrightheffing op pc's

Computerfabrikant Fujitsu Siemens Computers moet op last van een Duitse rechtbank een copyrightheffing voor nieuwe pc's gaan betalen. De rechtszaak was aangespannen door VG Wort, een Duitse organisatie die de copyrights van auteurs en uitgevers beschermt. VG Wort is van mening dat pc-makers een compensatie moet geven voor het digitaal kopiëren.

World's biggest-ever haul of blank CD-Rs is seized in Mexico

Almost 16 million blank CD-Recordable discs – a worldwide record – have been seized in raids in Mexico. The bulk of the discs are believed to have been destined for the country's piracy-ridden markets. The raids mark recent stepped-up enforcement efforts by the Mexican authorities to try and stem the overwhelming pirate music trade in the country.

Steenkool voor stoute platenbonzen en filmstudio's

Spotty shortages abound for Apple Computer Inc.'s wildly popular iPod digital music players amid Wall Street expectations for a doubling in sales of the devices in the holiday quarter, analysts said on Wednesday. SuprNova.org ends, not with a bang but a whimper

Suprnova's demise as a BitTorrent clearing house coincides with increasing legal pressure in America and Europe against P2P-enabled piracy. In the last week the Movie Picture Ass. of America signalled its intention to pursue the P2P server operators in a new front in its war internet movie pirates. Also, a popular BitTorrent site in Finland was raided by police, and an eDonkey site in the Netherlands was raided and shut down. According to a recent academic study, BitTorrent traffic accounted for 53 per cent of all P2P internet traffic in June.

Music download service targets Linux desktops, eases DRM

TheKompany.com today formally launched Mindawn, a music download service that, unlike iTunes and Napster, targets Linux desktops. Mindawn is claimed to provide CD-quality song files and "virtually no" digital rights management (DRM) restrictions, offer full previews of the entire songs, and provide downloads in "lossless" Ogg Vorbis and FLAC formats, as well as in other common "lossy" formats.

The BitTorrent P2P file-sharing system - indepth academic study

Analysis Even though many P2P file-sharing systems have been proposed and implemented, only very few have stood the test of intensive daily use by a very large user community. The BitTorrent file-sharing system is one of these systems. Measurements on Internet backbones indicate that BitTorrent has evolved into one of the most popular networks [8]. In fact, BitTorrent traffic made up 53 per cent of all P2P traffic in June 2004 [12]. As BitTorrent is only a file-download protocol, it relies on other (global) components, such as websites, for finding files. The most popular website for this purpose is suprnova.org.

RIAA sues 754 more P2Pers

The Recording Industry Ass. of America (RIAA) has filed a further 754 lawsuits against named and unnamed individuals it claims have infringed its members' copyrights. The latest round of court filings brings the total number of lawsuits the organisation has issued to 7706. However, there seems little sign that the RIAA's aggressive, highly public legal proceedings have had any real result.

The 5th IFPI Platinum Europe Awards, honouring artists who have sold in excess of one million albums in Europe, will take place in Brussels on 12th July, 2005. P2P Battle Reaches FTC

The Federal Trade Commission officially entered the brawl over peer-to-peer software Wednesday as it hosted the first day of a two-day P2P workshop in which both sides accused each other of trying to deceive government regulators. Representatives of P2P software companies charged that content interests have tried to demonize P2P in an attempt to effectively kill it. Content providers, meanwhile, argued that they merely want to make P2P networks more responsible to consumers and more respectful of copyright holders. In the middle is the FTC, which has become increasingly interested in P2P software because of a flood of consumer complaints about exposure to spyware, viruses and rampant pornography when using P2P technology.

New CD copy-lock technology nears market

A new kind of copy-protected music CD will likely hit U.S. shelves early next year, as record label Sony BMG Music Entertainment experiments with a technology created by British developer First 4 Internet, according to sources familiar with the companies. Several major music labels have already used a version of the British company's technology on prerelease compact discs distributed for review and other early-listening purposes, including on recent albums from Eminem and U2.

German software engineers Guido Ciberski and Petra Bauersachs are promising to introduce software they call 'Cybersky TV' this January. They claim Cybersky TV will use peer-to-peer technology to carry live television feeds. If the service gets enough users, its first broadcasts in February could revolutionize TV ‑ and guarantee a deluge of lawsuits. (...) Another benefit to Cybersky's design is that it's purely legal ‑ at least for now. Cybersky doesn't rely on a central server ‑ a legal fine point that sank Napster ‑ but will instead help users swap files among themselves. This has allowed alternatives to Napster, such as Grokster, to flourish. Last week, however, the Supreme Court decided to review a lower court's ruling that peer-to-peer networks are legal.

Dutch anti-piracy organisation BREIN, along with FIOD-ECD (Economic Inspection Service of the Fiscal Intelligence and Investigation Service), has raided two popular sites in the Netherlands that offered links to allegedly copyright-infringing content. FIOD-ECD has arrested eight people and seized eleven servers.

Hollywood Wants BitTorrent Dead

In the United States and the United Kingdom, the Motion Picture Association of America, the main lobbying arm of U.S. film studios, filed civil lawsuits against more than 100 operators of BitTorrent "tracker" servers that point to locations where digital files of movies, music and other content can be found. The MPAA also targeted operators of servers for the eDonkey and Direct Connect networks. The group's actions include criminal complaints and cease-and-desist orders issued to ISPs on four continents. Acting in cooperation with the MPAA, French law enforcement authorities took related action Monday, and actions by authorities in Finland and the Netherlands followed Tuesday.

Opsporingsdienst FIOD sluit grote eDonkey-sites

De fiscale opsporingsdienst FIOD-ECD heeft dinsdagmorgen in Rotterdam vier servers in beslag genomen waar de twee grootste Nederlandse eDonkey-sites op draaiden, zo heeft Brein bekendgemaakt. Er werden op negen plaatsen in totaal acht aanhoudingen verricht en elf computers in beslag genomen. Releases4u en Shareconnector boden links aan naar illegale bestanden die op inhoud en kwaliteit gecontroleerd zijn. Het gaat daarbij vooral om bestanden van de nieuwste films, videospellen, muziek en andere content. Brein was al langer in gesprek met de mensen achter deze sites, maar deze gesprekken liepen op niets uit. "De maat was voor ons vol, waarna we naar Justitie zijn gestapt", zo zegt Tim Kuik, directeur van Brein. (...) De schade van dit soort illegaal aanbod kan volgens Kuik behoorlijk oplopen. Hij wijst erop dat de eigenaar van de site Film88.com onlangs nog werd veroordeeld tot betaling van 23,8 miljoen dollar schadevergoeding.

FIOD-ECD haalt internetsites uit de lucht

De FIOD-ECD heeft vandaag de twee grootste Nederlandse portalsites uit de lucht gehaald. De sites boden links aan naar illegale bestanden die op inhoud en kwaliteit gecontroleerd zijn. Deze bestanden bevatten illegale kopieën van films, videospellen, muziek en andere content. Het gaat om de portalsites Shareconnector.com en Releases4U.com. Op negen locaties in Nederland zijn acht verdachten aangehouden. Verder zijn een aantal computers, vier servers en administratie in beslag genomen.

Muziekindustrie blijft klappen incasseren

Ook in 2004 blijft het illegaal downloaden van muziek de industrie zware schade toebrengen. De omzetdaling van de cd-verkoop met negen percent ligt in de lijn van de achteruitgang van de jongste jaren. Over de laatste vijf jaar incasseerde de platenindustrie al een verlies van 35 percent. De stijgende verkoop van muziek-dvd's is niet meer dan een pleister op een houten been.

Supreme Court to hear P2P case

The U.S. Supreme Court on Friday said it would hear a controversial case on whether file-sharing software companies could be held legally responsible for copyright infringement on their networks. The court's action is good news for big record labels and Hollywood studios, which have lost successive rulings on the issue in lower courts. They want software companies like Morpheus parent StreamCast Networks and Grokster to be held legally responsible when copyrighted material is swapped using their software.

Kazaa: "Kinderporno niet tegen te houden"

Tijdens het Australische proces tussen Sharman Networks (de eigenaar van Kazaa) en de muziekindustrie kwam Kazaa opnieuw in nauwe schoentjes terecht. De technologieverantwoordelijke van Sharman Networks verklaarde voor de rechtbank in Sydney dat het onmogelijk is om kinderporno van het netwerk te weren. EU neemt prijsbeleid iTunes onder de loep

Na een klacht over het prijsbeleid in Apple's Britse muziekwinkel, heeft de Europese Unie aangekondigd de prijzen van iTunes nader te bekijken. Neelie Kroes, de nieuwe eurocommissaris voor Mededinging, leidt het onderzoek. Begin december kwam het Britse Office of Fair Trading (OFT) tot de conclusie dat er grote verschillen waren, maar dat gezien de internationale status van Apple het beter was als de Europese Commmissie een uitspraak zou doen. (...) Omgerekend betalen Britse klanten 1,17 euro per nummer, terwijl in andere landen als Nederland en België liedjes 99 eurocent kosten. Amerikaanse en Canadese klanten zijn nóg goedkoper uit: zij betalen respectievelijk 78 en 61 eurocent.

The ongoing civil trial involving P2P file sharing network Kazaa highlights the risks corporates face by not locking down employees' desktop applications, say security experts. Did downloads curb 'Idol' single sales?

Lower-than-expected sales for the single from Casey Donovan, this year's Australian "Idol" TV show winner, may be due to fans preferring to pay for downloads of the track. While Donovan's single "Listen To Your Heart" debuted at No. 1 on this week's ARIA chart, it sold far fewer copies than last year's winner, Guy Sebastian. According to music news site Undercover, Donovan's single sold 35,817 copies in its first week, while Sebastian's tune sold 128,679--more than three times as many.

Artiesten ondervinden geen of weinig last van het illegaal kopieren van muziek via internet, blijkt uit een ondervraging bij ruim 800 artiesten dor het American Pew Internet Life Project. Napster creator unveils new company

The college student who five years ago incurred the wrath of the music industry by unleashing Napster, the internet file-swapping service, yesterday unveiled a new company he hopes will bridge the divide between record labels and peer-to-peer networks that continue allowing internet users to illegally share music. Shawn Fanning said his company, dubbed Snocap, had developed technology that would identify digital music tracks shared across the internet and create a system to collect royalties on behalf of copyright owners.

Tiscali moet toegang tot illegale muzieksites blokkeren

De Belgische auteursvereniging Sabam haalt een eerste slag thuis in haar rechtszaak tegen Tiscali, de op twee na grootste aanbieder van internetdiensten in België. De rechtbank van eerste aanleg geeft Sabam gelijk dat Tiscali zijn klanten de toegang moet ontzeggen tot websites waarmee ze illegaal liedjes kunnen uitwisselen. In de strijd tegen de muziekpiraterij op het internet werden zowel de websites waarmee je illegaal liedjes in huis kan halen, als de gebruikers van die sites al voor de rechter gedaagd. Maar Sabam gooit het over een andere boeg. De auteursvereniging viseert de internetaanbieder. Die moet zijn klanten de toegang tot zulke sites ontzeggen en hun software om liedjes te ruilen onbruikbaar maken.

Grote Bittorrent-sites uit de lucht

Wie Suprnova.org bezoekt, krijgt de volgende mededeling: 'SuprNova.org will be down for the next few hours due to technical isues. Please STAY TUNED!' Het lijkt er echter op dat niet technisch onderhoud de reden voor de sluiting is, daar ook andere bekende Bittorrent-sites uit de lucht zijn. Zo meldt Gfx4u.de melding: 'We are having LEGAL issues at the moment until this is resolved we will be offline'. Andere sites, zoals TvTorrents.net, geven simpelweg een blanco pagina. Het is niet ondenkbaar dat de entertainmentindustrie actie heeft genomen tegen de sites.
