SABAM starts legal action against Tiscali to block all P2P software in Belgium
SABAM, the Belgian Society of Authors, Composers and Publishers, has instituted on a prohibitory injunction in the court of first instance of Brussels againgst the Internet service provider Tiscali.

Ultratop voor internethits
Het legaal downloaden van muziek wordt stilaan een volwassen alternatief voor de verkoop van cd's. Er zijn zelfs plannen om ook in België vanaf 1 januari 2005 een aparte Ultratop hitparade op te stellen voor gedownloade singles. Ifpi, de belangenvereniging van de platenindustrie, wil de downloads ook meetellen bij de ,,gewone'' singles van de Ultratop. IFPI maakt gelijkaardige plannen in andere landen. (...) In België is het nog even wachten op de grote doorbraak van het betaald downloaden. Apple lanceert zijn iTunes pas in oktober. Voorlopig leiden vooral Napster en de Skynet Music Club, die de catalogus van OD2 verspreidt, de nog beperkte markt. ,,Nu worden nog maar een paar honderd nummers per week gedownload'', zegt Marcl Heymans van Ifpi België. Heymans vermoedt dat de digitale verkoop snel de verkoop van singles naar de kroon zal steken. België is van oudsher verknocht aan de single, in 2003 zijn er nog 4,5 miljoen verkocht. Singles dienen vooral instant luisterplezier, en kunnen dus makkelijk ingewisseld worden voor digitale downloads.

Tiscali aangeklaagd wegens illegale muziekdiensten
De Belgische auteursrechtenmaatschappij Sabam heeft gisteren een klacht ingediend tegen internetprovider Tiscali. Sabam wil dat Tiscali stopt met het aanbieden van bestanden waar surfers auteursrechterlijk beschermde werken, zoals muziek, illegaal kunnen downloaden. (...) Alle Belgische internetproviders geven toegang tot websites waarop die P2P-software te vinden is. Als de internet-aanbieders die toegang voortaan verhinderen, zou in België een eind worden gemaakt aan het fenoneem.

Press release: SABAM institutes prohibitory injunction against Tiscali
The Belgian Society of Authors, Composers and Publishers (SABAM) has instituted on Thursday 24th June 2004 a prohibitory injunction in the court of first instance of Brussels against the Internet service provider TISCALI. This injunction, which is a world's first, is justified notably in the European directive (2001/29/CE) "Information society". Through this injunction, SABAM wishes to put an end to the use in Belgium of all 'peer-to-peer' (P2P) file exchange systems through which thousands of copyrighted works are exchanged illegally at the expense of their authors, composers and publishers.

Perscommuniqué: burgerlijke stakingsvordering tegen ISP Tiscali
De Belgische Vereniging van Auteurs, Componisten en Uitgevers (SABAM) heeft donderdag 24 juni 2004 bij de rechtbank van eerste aanleg van Brussel een burgerlijke stakingsvordering ingediend tegen Internet service provider TISCALI. Deze vordering, een wereldpremière, vindt onder meer haar verantwoording in de Europese richtlijn - Informatiemaatschappij - 2001/29/EG. Met deze vordering wil SABAM een einde maken aan het gebruik in België van alle - peer-to-peer - (P2P) uitwisselingssystemen van bestanden waarmee duizenden auteursrechtelijk beschermde werken in alle illegaliteit worden uitgewisseld ten nadele van hun auteurs, componisten en uitgevers ervan.

Koffiehuis wordt digitale muziekwinkel
De nieuwste rage in Los Angeles is een koffiehuis van Starbucks dat tegelijk een ongewone muziekwinkel is. In het Hear Music Coffeehouse kunnen klanten luisteren naar muziek, maar haar ook op een schijfje laten branden: je kunt dus je eigen compilatie-cd maken. (...) Starbucks heeft ongeveer 5.400 koffiehuizen in de Verenigde Staten, en wil daar binnen de vijf jaar 2.500 van ombouwen tot Hear Music-trefpunt.

Loudeye buys OD2 for £21m
US digital music wholesaler Loudeye has bought On Demand Distribution (OD2), the online music distributor in Europe co-founded by Peter Gabriel, for $38.6m (£21m) in cash and stock. The move represents the first major consolidation of the digital music market in Europe, just as Napster and iTunes entered the fray last week. (...) Nieuwste cd Beastie Boys installeert stiekem DRM-software
Fans van de Beastie Boys komen van een koude kermis thuis wanneer zij hun pas gekochte album in hun computer stoppen om hem af te luisteren. Na meer dan vijf jaar stilte komt deze band namelijk met een nieuwe cd, die behalve de zo gewilde muziek ook een DRM-installer [Digital rights Management] bevat.

Napster geeft gratis muziekspelers weg
Sinds de muziekdienst Napster noodgedwongen legaal is geworden, is het aantal gebruikers drastisch teruggelopen. Een gratis audiospeler moet daar verandering in gaan brengen. Napster, onderdeel van Roxio, heeft namelijk laten weten iedereen die een jaarabonnement afsluit, een digitale muziekspeler te zullen geven.

Apple start met on line muziekverkoop in drie Europese landen
Apple start ook in Europa met zijn succesvolle on line muziekwinkel iTunes. Dat heeft topman Steve Jobs vandaag in Londen bekendgemaakt. Duitsland, Groot-Brittannië en Frankrijk, samen goed voor 62 procent van de Europese muziekmarkt, komen eerst aan de beurt. In oktober volgen andere Europese landen.

OD2 introduces its 'digital jukebox'
On Demand Distribution [OD2], the British company that controls most of the legal market for music-downloading in Europe, announced an upgraded service Monday as it tries to fend off rivals muscling in on its turf. The new service, which OD2 bills as a "digital jukebox," will be available immediately through four of those partners - Microsoft's MSN, MTV, Packard Bell and Tiscali - in Germany, France, Britain and Italy. Belgian and Spanish offerings, as well as further partners, will be added this summer, OD2 said. The service uses a version of Microsoft's Windows Media Player. It allows users to download from a selection of 350,000 musical tracks, or to listen to them once by "streaming" them over broadband connections. (...) OD2 launches UK music download store 1 day ahead of Apple
OD2 SonicSelector has launched its music download service in the UK, just one day ahead of Apple's predicted UK launch date. Like OD2's other retail partner's, it will offer music as pay-per-download and pay-per-listen. Consumers can listen to full tracks at 1p/1c per play and download tracks for 75p/99c a pop.

[VIDEO] Anti-piracy film trailer unveiled
A cinema trailer that compares the illegal download of films with other serious thefts has been launched in Australia, it is reported. The anti-piracy film likens such downloads to stealing cars, said film industry website Screen Daily.com. It said 1,900 copies of the trailer had been distributed, and the format would be adapted for use globally.

'Illegaal downloaden daalt met een kwart' Het Europese vervolg op de acties van de Amerikaanse muziekindustrie heeft merkbare gevolgen voor de illegale downloadactiviteiten bij ons. De dreiging van juridische stappen resulteerde al in verschillende schikkingen van duizenden euro's en in een aanzienlijke daling van het aantal downloaders. (...)

Lawsuits in Europe inevitable
The London based International Federation of the Phonographic Industry (IFPI) have prepared lawsuits against another 24 individual file sharers in Denmark, according to industry officials. (...) Individuals using P2P networks in Denmark, Germany and Italy have already been on the receiving end of lawsuits by the IFPI. (...) The BPI [British Phonographic Industry] has sent over 175,000 instant messages to those downloading music in the UK, warning them of possible legal action.

Eerste Duitse muziekpiraat veroordeeld
De muziekorganisatie IFPI heeft succes behaald in de strijd tegen muziekpiraterij. In Duitsland is voor het eerst iemand veroordeeld tot een geldstraf. De man bood ongeveer zesduizend muziekbestanden aan via Kazaa.

ITunes Europe to launch next week
Apple is to announce next week the European launch of its iTunes digital music download outfit. (...) Apple launched its legal download service in the United States last year to great acclaim, having sold more than 70m tracks in its first year of operation. The European launch has been long-delayed due to the complicated negotiations for rights on the continent, with each country maintaining their own rights regimes. However, where in the US, iTunes is the market leader, the company will find stiff, well-established competition in Europe, where digital music distribution provider OD2 has over thirty retail partners operating its download service, including Coca-Cola and MSN. Napster launched their British download service in May, and Sony's recently unveiled Connect download operation has said it has European ambitions as well, with a UK-France-Germany launch expected this month.

Copy-blocked CD tops U.S. charts
For the first time, the No. 1 album in the United States is loaded with anticopying protections, marking a clear step into the mainstream for the controversial technology. According to figures released by Nielsen SoundScan, Velvet Revolver's "Contraband" was the top-selling album in America last week, despite being prominently labeled on its cover as being "protected against unauthorized duplication."
